Arizona sheriff challenges Justice Department's request for documents
 
CNN) -- Sheriff Joe Arpaio of Maricopa County, Arizona, is challenging the Justice Department's request for certain documents in its investigation of alleged civil rights violations by the sheriff's office.
In a letter to the Justice Department on Friday, Arpaio's lawyer said the sheriff couldn't agree to the department's September deadline to supply all documents requested for its investigation and questioned the government's pursuit of broad access to documents, personnel and facilities in the inquiry.
The letter, from sheriff's office attorney Robert Driscoll, alleged that the Justice Department's position that it is "entitled to any document it wants, to access any facility it wishes, and to interview any witness it wants, without limitation ... is simply unreasonable."
Authorities are investigating whether Arpaio's policies and law enforcement sweeps discriminate against Hispanics.
Justice Department officials met Tuesday with Arpaio and his lawyers to request additional documents in the investigation. The department formalized the request in a letter to the sheriff's lawyers Wednesday.
The letter asked the sheriff's office to send confirmation Friday that it would deliver the documents by September 10.
In his letter to the Justice Department on Friday, Driscoll pushed back on that deadline, saying "we did not agree to a September 10, 2010 deadline at our meeting, and we cannot agree to one now.
"As I am sure you are aware," the letter continued, "MCSO [Maricopa County Sheriff's Office] like many other state and local governmental agencies, has limited resources which cannot be deployed indiscriminately without a potentially negative impact on MCSO's ability to perform its primary functions of enforcing the law and protecting the citizens of Maricopa County."
On Saturday, a Justice Department spokesman said the department expects to receive the documents on time, despite the Friday letter.
"We're reviewing the letter," spokeswoman Xochitl Hinojosa said in a statement, "but as we have said all along, we expect the sheriff's office to provide nothing short of full compliance with the law, as every other law enforcement agency in the country has done in similar circumstances."
If it doesn't turn over the documents, the government has threatened to sue the sheriff's office "to compel access to the requested documents, facilities and personnel," Assistant Attorney General for Civil Rights Thomas Perez has said.
Arpaio, who has called himself "America's toughest sheriff," is known for his hard-nosed opposition to illegal immigration.
Detractors accuse him of discriminating against Hispanics. Supporters say the Justice Department's civil rights probe and its separate criminal investigation are politically motivated.
In his Friday letter to the Justice Department, Driscoll claimed that some of the requested documents were already in the Justice Department's possession.

"I must say I was surprised at the apparent lack of command that any members of the DOJ team had over these documents," Driscoll wrote, referring to the Tuesday meeting. "Indeed many of the items your team claimed to need are among those documents that the DOJ has and has had for quite some time."

Barack Obama is holding border security hostage, and his ransom price is amnesty for the 12-to-23 million illegals currently in the U.S. I'll tell you what I'll tell the Obama if he comes to Arizona and sits down with me: We don't negotiate with people who hold hostage the security and safety of Americans!

SECOND, we cannot allow amnesty for 12-to-23 million illegals to pass Congress or be enacted by executive order by Barack Obama. We need 1 MILLION AMERICANS to sign our B.A.N. pledge to stop amnesty. We need to unite our voices so that together, our message to Washington is so loud it can no longer be ignored!


Fellow patriots, enough is enough. Today, the only reasons our immigration laws are not enforced are political. It isn't because our government can't, and it isn't because of any lack of authority. It is simply because the people in Washington don't have the courage or the character to get the job done.

Yes, this is shameful. Now is the time for us to act! Join me today and let's get the job done. Our nation, our security, and our future depends on what we do and how we do it!

U.S Selling Green Cards to Foreign Investors
 
A controversial visa program, the EB-5, issues green cards to foreigners in exchange for investments of $500,000 to $1 million that promise to create at least 10 American jobs. The government allocates 10,000 green cards for the EB-5 program annually.
 
U.S. Customs and Immigration Services (USCIS) justifies the EB-5 program as a job creating engine.  While many of the visa recipients are indeed entrepreneurial and have investment capital, most Americans would agree that selling green cards to the highest bidder is unseemly.  If the U.S. immigration system actually admitted individuals based on skills, education and ability to succeed, the EB-5 visa program would not be necessary. Unfortunately, admission into the U.S. is based on family chain migration which continues to perpetuate a flow of poorly skilled and heavily government dependent legal immigrants. 
 
The EB-5 program provides further evidence that our immigration system is broken. Instead of an immigration policy based on skills and societal contribution, we have resorted to selling citizenship as a means of attracting investment in private companies. In the meantime, our country is burdened with 13 million illegal aliens, an unsecured border, and a poor, unskilled, and largely government dependent legal immigrant population.
 

Administrative Amnesty

A series of recently disclosed memos reveals that illegal aliens currently under removal orders will be "expeditiously transferred" from U.S. Immigration and Customs Enforcement (ICE) to U.S. Citizenship and Immigration Services (USCIS) for suspension of deportation rulings. This will leave them free to stay in the United States indefinitely.  FAIR has been tracking this new "backdoor amnesty" tactic and is concerned that the trend will continue, expand and ultimately become irreversible unless the American public pressures their lawmakers to stop the administration from exerting undue Executive Power.

Background
One month ago, a U.S. Immigration and Customs Enforcement (ICE) memo outlined a path to amnesty for illegal aliens by limiting the enforcement of immigration laws for noncriminal aliens. At the time, ICE Director John Morton dismissed the memo as merely a draft and not necessarily reflective of the agency's policy.
 
However, yet another recently leaked memo outlines the specific steps ICE will take to expedite the dismissal of deportation cases. To reduce the backlog of immigration cases, Morton has instructed ICE to transfer illegal aliens under removal orders to USCIS where their deportation orders will be suspended expeditiously, allowing 17,000 cases to be dropped.
 
By prioritizing the deportation of some illegal aliens and dismissing the others, the Administration is undermining the immigration laws passed by Congress. Without the votes in Congress or the support of the American people, Morton and his colleagues have taken it upon themselves to enact comprehensive administrative amnesty in a stealthy, piecemeal fashion. 
 
A copy of the Assistant Secretary John Morton's August 20 memo is attached.  The memo confirms the Obama Administration's continued usurpation of power from Congress.

The Proof is in the Numbers: Enforcement is Down
 
The Department of Homeland Security (DHS) recently released its 2009 Yearbook of Immigration Statistics. After touting increased border security and interior enforcement, the report shows that Homeland Secretary Janet Napolitano has been all talk in her first year.
 
While Secretary Napolitano and President Obama claim to be getting tough on immigration, via a $600 million border security bill, their commitment to interior enforcement is lacking. Apprehensions, investigations and voluntary returns of illegal aliens are all down from 2008. The only category that has improved slightly is total removals, but many of these cases were backlogged from the Bush Administration.
 
In addition to the yearbook data, FAIR recently gained insight into how worksite enforcement is going this year. Administrative arrests – arrests of employees for immigration violations only – are down, as are criminal arrests of employees and employers. By replacing worksite enforcement with paper audits, employers are merely fined and illegal alien employees are released to find work elsewhere.
 
The consequence of neglecting interior enforcement is the continuation of illegal immigration. Once safely across the border, illegal aliens are increasingly welcomed by the federal government, while taxpayers and communities bear the burden.
