Nice story, here your frined would be sent to jail.
Even those who have a defense for carying a befense weapon can not use it unless their live is at risk, and the only way acceptable in our courts that our live is at risk is after beeing shot to death. Even if you, or a police officer finds someone stealing your property, the judge will require proof that he was really stealing, even when caught in flagrant.
We have very nice laws, from the buglars poin of view, of course.

I have a friend that has a licensed 'tommy gun' (think 1930's gangster
automatic weapon), and several other automatic weapons. He does not
load his own, but he does not shoot much either. ... He said the
hardest weapon to get licensed was the 22 with a build in silencer ...
Funny about that.
One day he found a fellow who was fishing on his pond that was
trespassing (Yes, the area was posted). The trespasser basically said
'bugger off'. So my friends rifle range went across the area between
his house and his targets, where the house access road was on one side
of the range, and the pond was on the other side. ... So he said OK,
went to his house, pulled out his tommy gun, and let off about 50
rounds. Once target practice was over, the trespasser decided to
leave. Funny about that.
It is a fun story. ... My friend does allow people to fish at his
pond, but they are required to ask, and have him grant permission
before being allowed.
Oh yes, this was in the North East part of the USA, not in the 'wild west' :)
